The word "Marina" is used here to indicate any person authorized to represent Spring Brook Marine. The word "Tenant" is used to indicate the owner (or the authorized representative) of any property at Spring Brook Marine.

This lease is non-transferable and is valid for a Dock space from April 1 - October 31. RV, Ramp Pass and trailer storage is May 1 September 30. No refunds. No exceptions. Winter storage fees will be billed separate.

To be admitted and to continue as a Tenant of the Marina, property must be:

a. Used for pleasure only;

b. Registered, identified, marked, equipped and maintained as required by law and safe practice;

c. Subject to periodic inspection by the Marina to determine the maintenance of proper safety conditions.

No insurance is carried by Spring Brook Marine on customer owned property. Therefore, this contract is accepted at the sole risk of the owner who hereby releases Spring Brook Marine from any and all claims for loss or damage however caused.

The Tenant agrees to have proof of insurance with complete Marina coverage including liability. Each Tenant is responsible for damages he or his guests may cause to other property in the Marina or to any structures of the facilities thereof.

All property shall be secured in their spaces in a manner acceptable to the Marina, or the Marina will adequately secure the property at the Tenant's expense.

Any owner whose vessel is sold during the term of this contract, even without the efforts of Marina Personnel, will be assessed a 10% fee of actual selling price.

In any event of severe weather or flooding the Marina will attempt, if possible to provide preparation and damage protection service, the cost for which will be invoiced and the responsibility of the Tenant. Tenant is still solely responsible to take measures, and the Marina does not assume any responsibility for said protection and/or damages to the Tenant's property.

Any infraction of the terms and conditions herof or the ruls and regulations by the Tenant or guest of the Tenant will render this contract cancel-able and the Tenant shall remove any contracted property with refund.

All charges will be a incur a 2.99% convenience fee if paid with a credit card. The card member acknowledges the amount and agrees to the charges.

All reasonable precautions will be taken by the Marina to ensure the Tenant's property and safety. However, the Marina assumes no responsibility for the safety of any piece of property in the Marina and will not be liable for fire, theft or damage to said property or personal property, its equipment, or anything in, on or around however arising.

The Tenant shall provide the Marina with the location of a main door key, hatch and ignition keys for emergency service.

If you do not Dry Dock at Spring Brook Marine you will not be eligible for the same space, and/or anyone having any invoices over 30 days past due will not be eligible for launching or the following years space.

The Tenant (and guests for who he is responsible) agrees to conduct himself at all times when on the property of the Marina, so as to create no annoyance, hazard or nuisance to the property or to other Tenants. This involves observance of good housekeeping and sanitation practices.

No mounts, posts, tents, storage containers, fences, laundry structures, etc. to be attached or displayed on the property.

For safety and insurance measures NO outside labor will be allowed on Marina property.

In the event of an emergency during the Tenant's absence, the Marina is authorized to make necessary repairs or relocated the customer property as the tenants expense.

Any condition on the tenants property, in the opinion of the Marina that constitutes a fire hazard or a health nuisance or danger to public safety, must be corrected immediately by the tenant or the contract will be revoked without refund.

NO oil or inflammable liquids shall be thrown, pumped overboard or disposed in refuse containers. No fueling on or near the docks.

Garbage must be deposited in receptacles supplied for that purpose.

Tenant shall not store supplies, materials, accessories, or debris on any walkway, and shall not construct thereon any lockers, chests,cabinets, or similar structure. Painting, scraping, or repairing of gear on properly is not permitted.

Noise and language shall be kept to a minimum at all times. Tenant shall use discretion in operating engines, generators, stereos, radios, and television sets, so as not to create a disturbance.

Swimming or diving is not permitted from the piers or boats in the harbor.

Neither "for sale" signs nor other signs may be posted on any marina or personal property. No exceptions.

The entire Marina facility including the gas dock is considered a NO WAKE AREA. The vessel owner shall be responsible for any and all damage incurred.

It is not permitted to leave air conditioning or heat running while your unit is not occupied.

Golf Carts are restricted to electric ONLY. Speed limit of under 5 MPH does apply. Operators must have a valid drivers license. Operation at night requires head lights. Operator is responsible for any accidents, injury, etc. Any other types of motorized items are not allowed.

If a delivery captain or a mechanic is contracted to perform a service the customer agrees to release Spring Brook Marine or the delivery captain/mechanic from any and all claims, damages, suits, or causes of action or nature of any kind.

Pets must be on a leash at all times. Owner is responsible for the sanitation concerns and will have control to insure peace and privacy of other tenants.

No vehicle parking or objects in grass areas to obstruct the landscapers

All building and ramp keys must be returned by Sept 30 or a $50.00 fee will be charged.

All tenants are restricted to Spring Brook property limits

Authorization for the use of the ramp, dock, RV space, or building to a non member will cancel this contact with no refund.

All small children are to wear life vests on docks or near water.

Absolutely no running on docks or throwing stones into water.
-
No grill cooking via charcoal, propane, alcohol, electric, or any other sources is allowed on the docks or piers.
